TERMS AND CONDITIONS

The company BADITS FASHION BRAND SL - B66873035, registered in the Mercantile Register, volume 45599, folio 137 and page nº B 493206, 1st inscription, is the owner of this Website, operating under the trade name BADITS FASHION BRAND S.L. These general conditions are formulated in accordance with the Civil and Commercial Codes, Law 7/1996, of January 15, on Retail Trade Regulation, Law 7/1998, of April 13, on General Contracting Conditions and Law 7/1995, of March 23, on Consumer Credit. Placing an order implies acceptance of these General Terms and Conditions of Sale by the customer, as well as any other specified in the order itself. In addition, the BADITS customer confirms that they are of legal age and verifies that all data provided for the management of their order is correct.

1- OBJECTIVE These General Terms and Conditions of Sale aim to define the sales modalities between BADITS and the customer, from placing the order, delivery and payment, as well as the after-sales service.

2- ORDER The CUSTOMER can place their order through the different devices that allow them to access the website www.badits.com in the section containing the online store. For any questions in the process, you can address your questions and comments to the following email address: online@badits.com or by phone, 93 200 14 85, corresponding to the physical store, during business hours, defined on the same website in the schedule section. To place an order, the Customer must provide us with their personal data, thus being in the BADITS database. The placement of an order by the Customer is equivalent to full and complete acceptance of the prices, the description of the products for sale and the General Terms and Conditions of Sale, as well as any other specified in the order itself.

3- DELIVERY. The order will be delivered once payment for the merchandise has been made through the website. Delivery time can be 2-6 business days, depending on the delivery address. In case you are not found at the specified destination address, the transport agency will leave you a notification with a phone number to arrange a new delivery within a maximum of 10 days. At BADITS, we track each order, so if any incident arises in your shipment, we will notify you as soon as possible. If a delivery date has been agreed with you for the merchandise with the transport agency, and delivery cannot be made because you are not at home, additional charges may be applied for a second delivery attempt.

4- PAYMENT We offer a payment method via credit card through an online POS via a secure server of a banking entity. Badits offers you different payment methods. We detail them below:
1. CREDIT OR DEBIT CARD: The charge will be made in real time, through the secure payment gateway.
Compatible cards are: MASTERCARD, VISA, VISA ELECTRON, and AMERICAN EXPRESS.
2. PAYPAL: Secure, fast and simple payment with Paypal, where the sales commission charged by Paypal will be paid by Badits.

5- PRICES All prices and fees derived from the services provided from our website WILL include value-added taxes (VAT). Shipping costs are set at €4.95 per purchase in the Peninsula (free for purchases over €300), €8.95 in the Balearic Islands. We do not ship to the Canary Islands, Ceuta or Melilla. For shipments within Europe, the rate is €7.95 per shipment. For international shipments outside Europe, the rate is €50.

6- RIGHT OF RETURN The user will have 30 days to withdraw from their purchase and return the product from the moment they receive the item or items of the order. To make any change or return of any product, the user must return the product in perfect condition and without having started its use. Returns of items without tags, boxes or original packaging will not be accepted. The shipping costs of the return are borne by the customer and they must manage this process. Once the material is returned and its correct condition is verified, the amount of the product paid, less shipping costs, will be refunded within 14 days following the effective receipt of the returned product, using the same purchase method used by the buyer. Exclusively if the return is due to an error attributable to BADITS, the shipping costs and the return of the product will be assumed; otherwise, the user must pay the costs. Returns are not accepted for any lingerie items.

7- WARRANTIES. In case of a defective product, the seller must respond to the lack of conformity that manifests itself within two years from delivery. Never in case of defect or wear and tear due to use. The consumer and user must inform Badits of the lack of conformity within two months of becoming aware of it. In case of a defective product, the seller must proceed, as appropriate, to repair, replace, reduce the price or terminate the contract, actions that will be free of charge for the consumer and user.
